Default Mystery deepens over assault on Sen. Rand Paul

Kentucky Sen. Rand Paul is recovering at his Bowling Green home after being physically assaulted Friday afternoon by a neighbor. The assailant – 59-year-old Rene Boucher – was arrested by Kentucky State Police and charged with fourth-degree assault, authorities said.

U.S. Capitol Police and the FBI are investigating the incident because assaulting a member of Congress is a federal crime.

I’m trying to take this seiously, but they’re saying it may have been a dispute over landscaping. He couldn’t just leaf that alone?

To his credit, at least Rand Paul doesn't seem interested in using the incident to rake in publicity... given today's political landscape.

A completely unsubstantiated comment elsewhere (guy claimed to live in the same community and knew both parties) claimed that the Boucher was known to be difficult. So there's that.

Part of me thinks that Paul's relative silence and the "nothing to see here, just a landscaping dispute between neighbors" is shorthand for "we don't want the real reason getting out".

Despite the fact that the puns are fun and I happen to despise his politics, I hope he has a swift recovery. Broken ribs are no joke. I also hope justice is done. Attacking a senator is also no laughing matter.

To that last point, however, since he is a representative, I think the public does deserve a public explanation. It's claimed that Paul was "embarrassed" by it and does not want to "draw attention to it". Hardly an easier way to draw attention to it than to say he's embarrassed to be attacked.

The other question is also about the severity of the crime of attacking a senator. Why in the world are the charges so light? White, rich, professional privilege certainly could take a few years off of a sentence but a misdemeanor "fourth-degree assault"? Ordinarily I wouldn't call for tougher sentencing but there has got to be some explanation - besides the usual horrific prejudice of the justice system.

Those are the KY State* Police charges. He may yet be charged with a Federal crime.

The charges were filed before the extent of injuries were known. I'm sure the sate charges will get boosted and the federal charge will be significant.

Does double jeopardy apply here? Can he face both sets of charges?
