I'd prefer it not have to get that far. Would this start out with SCOTUS or would it be with a district court first and then follow the normal appeal process?

GenYus, re visiting the website now: I don't know. I just went to the site, though; if only out of curiosity, as I hadn't heard of it before.

Re the story linked: sounds like DOJ filed in the court first; and DreamHost filed in response.

I don't think anything ever starts out with SCOTUS, does it? I think they only take cases that have gone through the rest of the court process first. -- huh, I just looked that up and apparently I'm not quite right; but this case wouldn't qualify for original jurisdiction, if I'm reading the page right.

I would also prefer it not to get that far -- but only if the reason that it doesn't is that the Current Administration backs down. I hope DreamHost doesn't. Their website makes it clear that they cooperate with reasonable subpoenas; they shouldn't with this one.

Great, so hopefully the Washington, D.C. Superior Court will see the light and snuff this overly broad request right out and the DOJ either won't appeal it or the appeals and higher courts will refuse to hear the appeals.

As you note, indeed some things can originate at the SCOTUS. The SCOTUS has even tried a criminal case (not an appeal, but an actual trial that originated at their level).
