Canada Judge finds 'flamboyantly' gay man couldn't have raped his female roommate

A Canadian judge ruled that a Winnipeg man who was accused of sexually assaulting his female roommate couldn’t have perpetrated the crime because he is gay.

Yes, the judge did find that. Not because he was gay, but because there was no physical evidence that he raped her and her testimony was shaky. But why let facts get in the way of a good headline?

Well, yes and no. The DNA evidence is clearly good enough reason not to convict but I am rather confused why the judge felt the need to bring up his "But I'm gay" defence as if it were meaningful.

It's hard to tell, but it looks possibly like the defendant raised that subject as part of his defense.

It is worth bearing in mind that the Winnipeg Sun is part of the Sun chain of tabloids in this country. If there's a shocking (if misleading) spin to put on a story, they'll do it.

Yeah, from my reading, it's just false. The judge found the man not guilty. I assume it works the same there as here--the verdict means the case wasn't proven. As a legal matter, he didn't commit the crime in question, but there's nothing in the article showing that the judge found that he couldn't have.

It's odd I can't find a version of this story that isn't a word for word repeat of the OP's story.

It does appear the man made his sexuality part of his defense (not the worst idea necessarily) in defense of the headline. But yes it also appears that the finding of not-guilty was based on more than "Well he's, like, super gay, so he clearly didn't do it".
