Soapbox '8THEIST' license plate rejection violates First Amendment, woman says

A New Jersey woman filed a lawsuit against the state Motor Vehicle Commission saying its rejection of her request for a vanity plate that reads "8THEIST" is a violation of her First Amendment rights.

More examples of the religious domination of this country, even if it is a more subtle and largely unimportant area of it.

I do like that most comments (on a scan through) are pretty good, I particularly like this one:

One thing I'm wondering: if people are seeking "8theist" and "athe1st" plates, isn't that because someone out there already has "atheist"?

Probably, the article commented that the "athe1st" one made it through, just they are typically held up because at least some of the people in charge of screening these things wrongly assume that the word Atheist is offensive.

Maybe it's just me but if I saw a license plate that said 8theist I wonder if she believed in 8 gods.

There was one time that snopes posted a list of forbidden licence plate numbers from some jurisdiction. That got me curious as to what forbade a specific combination. So, I contacted Service New Brunswick. In essence:

- any combination that would interfere with the current or past letter/number scheme. For example, currenly it is AAA 111. So asking for one with my initials and the last three numbers of my phone number would not work.

- any letter/number combinations that would create confusion as to what the true letter/numbers are. For example, substituting a number 0 for a letter O. As in H0MER. Other numbers are not likely an issue, but the 0 and O combination is.

- any letter/number combination that is deemed to be offensive, racist, sexist, contain curse words etc. My favourite was 3M TA3.

- any letter/number combinations that are protected, such as for corporation use, fleet vehicles etc. Made up example would be RICHCO 1, for my future corporation when it exists and I secure the name, although do not have the vehicle for it yet.

The 8THEIST may be read as HATE THEIST. That may be why ATHE1ST survives but that one does not. The number 8, with its connection to 88 HH etc is sensitive enough.

Speculation on my part, but something to think about.

It's highly subjective what the DMV will allow or not. And some of them will be approved, but if there are complaints from other drivers, may be revoked.

I've seen "H0PHEAD" be denied (it means "Hop Head" = hoppy beer fan... not sure how that is offensive, except perhaps the "Head" part), and "PR0ST" be asked second questions. They approved "HUNDWGN" for my station wagon with which I move my 2 dogs around. (It's a Volkwagen).

I believe hophead has been, in the past, slang for a user of illegal amphetamines.

ETA: More generally, an addict, according to Merriam-Webster.

Some states don't allow alcohol references, so hophead and prost wouldn't be approved under that rule.

That word comes up in some folk songs. Merle Travis sings "come on you hopheads and listen to me; lay off that whiskey and let that cocaine be..." at the end of Cocaine Blues.

Article and list of banned NJ license plates as of 2013. I was wondering whether they have a ban on all religious references, but "Jew" and "Jihad" are the only ones I see on the list. Is it possible the DMV thought a reference to atheism would provoke road rage? I seem to remember reading an article listing that as a reason for rejecting certain plates.

The whole process isn't terribly consistent though. I saw a plate today that read "CCCP" and was surprised that one was approved.

It's possible.. Though they initially blocked the first one and it was only after a fight that it went through.

It could be that the DMV employee who approve that is too young to know or never really paid attention to what the Soviets called themselves in Russian. If it weren't for watching the Soviet space program, I'm not sure I'd have known about it.
