Restaurant goers at Roberta's, a pizzeria in Bushwick, Brooklyn, got more than just their dinner. Customers got an eyeful when they were being served by a naked waitress.

I'm honestly surprised she wasn't arrested. I mean, I have nothing against public nudity in a philosophical sense, but I'm pretty sure it's against the law in NY still.

I honestly don't know. It would depend on the composition of the crowd. But I'd imagine if there were people with kids there, the likelihood would be decent.

The fact that there's no mention of police in the news report would tend to indicate that no one called them.

I didn't mean to infer that police were called and she wasn't arrested. It should have been phrased "I'm surprised no one called the police"

Public toplessness is legal in New York, but public nudity isn't. If all she was wearing was boots and stockings, I think that breaks the law.

It isn't illegal here. I've seen plenty of topless women at Pride and the Boriqua and Italia day parades. She was wearing boots, fishnets, and an apron... she's golden. I especially loved the peace out in sharpie across her back.

No, it actually doesn't. See through clothes are not illegal. If they were large portions of NYers would have been arrested at some point in the 90's. You have to have an article of clothing on your bottom half. Panties and stockings count, you do not need both. I'm actually pretty sure it was upheld that body paint was acceptable a few years ago.

Of course, there is the possibility that this is a staged publicity stunt. The waitress might not even have been a waitress there, just a stripper hired for the day.
